Power Inquiry - getting directors to testify

The head of a parliamentary inquiry into NSW's $5.3 billion electricity sale believes he can convince two former directors of power companies to give evidence without a court summons.

Public hearings will be conducted on Monday and Tuesday of next week, with witnesses to answer questions about the midnight electricity sale as well as the failed Tillegra Dam project.

After the premier threat that witnesses will not be protected by Parliamentary privilege it means any allegations of corruption that may arise from evidence could result in the witness being sued.

"I believe I can get around that," Mr Nile said on Tuesday, adding that any evidence considered controversial or commercial in-confidence could be given in closed sessions.

"If I can get these people to agree to that it may help them to appear then as a witness...

"I'm very keen for them to appear, particularly Michael Knight, as he is one of the best-informed of the whole group."

Mr Nile is still chasing up the other six former directors who have declined to appear at the committee's invitation.

All eight directors quit their positions at Eraring and Delta in protest just prior to the government announcing the partial privatisation on December 15.

Witnesses who are confirmed to appear include current Eraring director Tim Yeadon, NSW Treasury secretary Michael Schur, Treasury deputy secretary Kevin Cosgriff and other government employees.

Premier Kristina Keneally and NSW Treasurer Eric Roozendaal are also scheduled to appear on Monday.

"If the committee can meet,and in fact the premier appear as a witness, all of her scaremongering about (the inquiry) being 'illegal', 'unconstitutional' is ridiculous," Mr Nile said.

The committee is scrutinising the December sale to private companies but its legitimacy came into question when the premier moved to prorogue parliament after the sale.

Ms Keneally has since backflipped and has agreed to appear as a witness.

But she has cast doubt over the proceedings after seeking legal advice as to whether witnesses will be protected under parliamentary privilege while parliament is prorogued.

Mr Nile also said members of parliament have put 140 questions on notice for the government to answer at the inquiry.

"I notice there are some embarrassing questions about the Tillegra Dam that was suddenly cancelled," he said.

The government spent $100 million on the $477 million Hunter Valley project before dumping it in November.

"So there are some other embarrassments for the Labor government and they would probably like to keep the lid on it."

Mr Nile wants to convince the reluctant directors to give evidence before the inquiry but would support a court summons to compel them to appear, according to media reports.

NSW Opposition Leader Barry O'Farrell said he supports court action but would prefer the government to recall parliament.

"Reopening parliament would remove any legal concerns, allow these directors - and anyone else - to give evidence to the inquiry and finally start to answer the community's questions," he said in a statement.

NSW Power Inquiry Continues

The inquiry into the New South Wales government's planned $5.3 billion power sell off continues in Sydney on 18th January 2011.

The State's Premier, Kristina Keneally, and state Treasurer Eric Roozendaal were grilled at the hearing yesterday.

Ms Keneally refused to rule out suing eight energy company directors, who quit over the planned power deal, if they talk to the inquiry.

Ms Keneally also admitted she closed parliament last December, knowing it could derail any scrutiny over the power sell off.

NSW Treasurer Eric Roozendaal says he's 'not at all concerned' by what former energy directors could tell an inquiry into the state's electricity assets.

Eight directors who quit over the government's $5.3 billion power deal had refused to give evidence over fears they may not be protected by parliamentary privilege.

But the chair of the upper house inquiry, Fred Nile, told the first day of hearings on Monday a number of them would summonsed to appear at a hearing next week.

Mr Roozendaal on Tuesday welcomed 'any scrutiny', saying the entire process had been 'very public' from the start.

'I am not at all concerned (about letting the former directors speak about why they resigned) and I welcome anybody to make any contribution,' he told ABC Radio.

'I welcome scrutiny because I am confident that this transaction will stand up to any scrutiny at any point in time.'

The treasurer was asked why Premier Kristina Keneally had refused to recall parliament to indemnify the directors or to guarantee the government wouldn't sue them.

'It's up to those individual directors if they choose to participate in this process,' Mr Roozendaal replied.

He also dodged questions about his own duties as treasurer, remaining adamant he had done everything required of him for the people of NSW.

'It's my responsibility to ensure that this transaction is done appropriately, meets all probity requirements and is open to all proper scrutiny and I've certainly done that,' Mr Roozendaal said

10-DAY APPROVALS UNDER NSW Housing Code

The NSW Government has expanded the categories of low impact development which qualify for a 10-day approval under the NSW Housing Code.

The changes will allow certain low impact developments to avoid full development application procedures and be approved by accredited certifiers. Providing the meet strict design criteria, the changes apply to-

• new dwelling houses
• attic conversions
• extensions
• basements
• garages
• carports
• rear lane developments

The previous minimum lot size for this streamlined approval system was 450 square metres, however, changes to the Housing code now allow lots of 200 square metres and above to apply.

A separate code for rural areas is also being introduced including development criteria that have been specifically tailored to account for the unique qualities of these areas.

The changes to the State Environmental Planning Policy (SEPP) relating to exempt and complying development codes have been formally approved and will commence on 25 February 2011.

Security of Payments Act Update

As some of you may be aware the NSW Government recently conducted a review of the Act.

Well some amazing progress has come out of it. On 29th of November an amendment to the Act was tabled but is yet to come into operation.

It allows the Claimant to freeze the claimed amount from the Prinicpal to the Head Contractor, or else one step up the contractual chain. So if you are working for a Head Contractor, you can have the claimed amount left out of the next payment from the Principal to the Head Contractor, until the adjudication is decided. How good is that?!

This is how it will work:
1. You take the claim process to the point of preparing an adjudication application
2. You serve a 'Payment Withholding Request' on the Principal
3. You lodge the adjudication application
4. If you don't know who the Principal is you can request that the adjudicator direct that the Respondent provide all the details. If the Respondent refuses, they can get fined.
5. Upon receipt of a 'Payment Withholding Request' the Principal must withold that amount from the next payment to the defaulting contractor (Respondent).
6. The obligation to withhold the money lasts until whichever happens first: 1) The Respondent pays, 2) a period of 20 business days elapses after the Principal gets a copy of the adjudication determination
7. You must serve a copy of the adjudicator's determination on the Principal within 5 business days of receiving it.

If the Principal ignores the request then the Principal becomes jointly and severally liable with the Respondent to the debt owed to the Claimant! So then they both owe you the money!

The value of adjudication has never been higher.

Quality v Cost

The impact of the Global Financial Crisis (GFC) is starting to have an impact on the Building and Construction Industry through a reduction of work available causing Contractors to tender for work "at" or "below" cost.

Back were the days when there were 4 or 5 competitors at a tender meeting. Now it has been reported that up to 30 competitors are attending tender meetings competing for the same project.

The big picture here which is being overlooked is that by choosing the cheap options quality is being sacrificed for cost.

Principal previously awarded tenders on "best value" and "high quality". However, now we are seeing more and more tenders being awarded based on how cheap they are. This is causing a lot of reputable companies to either go bust or lower their standard, which in turn affects their reputation. This would be hard to heal in a recovering economy.

Cost cutting which compromises the quality of Construction is therefore a false economy.

Although the Government has not much helped in this area with their stimulus packages being handed out to blue chip companies, there are professionals out there and industry associations like the Civil Contractors Federation (CCF) that can help.

Those companies which pride themselves on quality must attempt to survive this current financial market without having to sustain heavy losses or damage to their reputation. Once the current economic climate starts to improve, those who have sustained without irrecoverable damage will benefit from the recovering market.

Project management is the process by which a project is brought to a successful conclusion.

Construction Project Management is the overall planning, co-ordination and control of a project from inception to completion aimed at meeting a client’s requirements in order to produce a functionally and financially viable project that will be completed on time within budget and to the required specifications and quality standards.

The Australian Institute of Project Management (AIPM) is the peak body for project management in Australia. Formed in 1976 as the Project Managers' Forum, AIPM has been instrumental in progressing the profession of project management in Australia over the past 30 years.

Construction projects are becoming more and more complex which is due to a number of reasons: projects which are larger in scale; technological advancement and applications of new construction methods and materials; emphasis on sustainability in terms of time, cost, quality, environment, technology, and social and political measures; changing needs of the clients; integrated supply chain alliance in construction.

The management of construction projects embraces and comprises all of the modern management methodologies and principles including project management and applies them across the different phases of the construction project development life-cycle to achieve successful project outcomes in terms of time, cost, quality, safety, and sustainability. There are millions of dollars and weeks (or months and years) of time to be saved by appropriate management of the entire project development process.

ABCC Continues the Fight Against Unlawful Union Activity

The newly appointed Leigh Jones, head of the Australian Building and Construction Commission (ABCC), says the commission will take on a extended regulatory role to that currently.

The Howard government set up the commission initially to help curb illegal industrial action. However Unions claim it has too much power to target them.

Appearing before senate estimates yesterday Mr Jones noted the ABCC has terminated its long-standing practice of referring wages and entitlements claims to the Fair Work Ombudsman and will recover wage and entitlement under payments for Building and Construction Industry participants.

"As commissioner, I'm determined the ABCC evolve into a full service regulator," he said. "The ABCC will continue to work towards eliminating unlawful industrial action.
"The ABCC will promote harmonious equitable practices on site and tackle issues including sham contracting and underpayment of building workers."

The Federal Opposition and construction unions have both reacted uneasily to the remarks. The Opposition's workplace relations spokesman Eric Abetz says the Fair Work Ombudsman already investigates employers. "The concern is the focus will be away from stamping out thuggery," he said.

The CFMEU faught hard to remove the Howard Government as it claimed the Liberal Government had extreme laws regarding Work Choices that needed to be abolished. After leading their members to belive that it was the Howard Government that was taking thier rights away, now the CFMEU is running campaigns on how the Labour Government is spending unnecessary tax payer dollars to fund the ABCC and its unlawful activities.

CFMEU's Dave Noonan says the commission is a fundamentally discriminatory body. "Any changes within the existing institution of the ABCC are only cosmetic," he said.

However Th Austraian has reported that BUSINESS groups have told the government not to dismantle the Australian Building and Construction Commission.

"We strongly support the retention of the ABCC in its current form, with its existing powers, structure and funding intact," Victorian Master Builders Association head Brian Welch said. Mr Welch said working days lost per 1000 employees due to workplace disputes in the building industry had fallen by more than 90 per cent since the creation of the ABCC, while wages for building industry workers had risen by more than 30 per cent.

ACCI director of workplace policy David Gregory said the ABCC played a key role in dealing with the worst excesses of behaviour in an industry that contributes almost 10 per cent of GDP. "It will be a major step backward if the gains that have been achieved in the last five years in the Australian building and construction industry . . . are put at risk or threatened by changes to the structure or powers of the organisation," Mr Gregory said.

The Government says it is confident the ABCC is acting in line with its legal requirements.

Labour Government Appoints New Construction Watchdog

The new federal Labor government in the first week of October appointed lawyer Leigh Johns to head the Australian Building and Construction Commission (ABCC), the building industry watchdog that has extraordinary powers to harass and prosecute construction workers.

The Labor government that took office after the 2007 election retained the ABCC, established by the former Coalition government in 2005 and all its coercive and punitive powers. The Labor Party promised to replace the ABCC by 2010 however this is not the reality.

John’s appointment, just one day after former ABCC head John Lloyd ended his five-year term on September 28, is a signal that the minority Labor government established after the August 21 election will fully support the agency’s ruthless crackdown on any attempt by building workers to defend their jobs and conditions. This is clearly not what was promised by the Labour Party at the time of First Election in 2007.

Before the election, Prime Minister Julia Gillard had informed Lloyd that his tenure would not be renewed. A new appointment could not be announced by the caretaker government during the election campaign and was further held up by the horse trading that eventually produced a Labor government backed by the Greens and independents.

Currently the ABCC has 90 investigations and 38 court cases underway, including the prosecution of South Australian construction worker Ark Tribe, who faces six months jail for the “crime” of refusing to answer ABCC questions over an allegedly unlawful strike.

Under the new ABCC head, there will be no lessening of its punitive measures against building workers. Johns was the ABCC deputy commissioner for seven months before leaving on January 31 this year. He took up the position of chief counsel in the Office of the Fair Work Ombudsman, part of the Labor government’s industrial relations policing agency, Fair Work Australia (FWA).

In a statement on the ABCC web site in January announcing John’s departure, Lloyd praised his former deputy as an “energetic and able leader who managed the affairs of the ABCC’s largest division, the Operations Group, with a high degree of professionalism”.

The corporate establishment recognised that the Gillard government’s prompt appointment of a new ABCC head was a further confirmation of Labor’s pledge to “keep a tough cop on the beat in the construction industry”.

In appointing Johns, Workplace Relations Minister Chris Evans reiterated the government’s support for the anti-working class body. “I look forward to working closely with him and the ABCC in bringing about continued improvements in workplace relations in the building and construction industry,” he said. “Labor has made it clear that industrial lawlessness and thuggery will not be tolerated”.

Evans also restated that the government’s commitment to replacing the ABCC with a specialist division within the FWA policing regime to be known as the Fair Building Industry Inspectorate (FBII). The new watchdog will retain all of the ABCC’s coercive powers for at least five years.

The FBII was due to be established by February 2010, but faced opposition in the Senate. The Liberals accused the government of “watering down” the ABCC, but Labor’s so-called safeguards are purely cosmetic. The “safeguards” included subjecting the use of coercive powers by the new agency to approval by a presidential member of the Administrative Appeals Tribunal. Given Labor’s commitment to continuing a “tough” regime in construction industry, it is unlikely that FBII requests would be denied.

Other “safeguards” included allowing workers brought in for interrogation to access a lawyer of their choice. The Commonwealth Ombudsman would also be required to “review” all of the inspectorate’s compulsory interviews and report to parliament—that is after the event. And the penalties for refusing to answer would still stand.

As the required legislation has not been passed, the ABCC remains in place.

Last week as the Gillard government appointed Johns to head the ABCC, the Greens introduced legislation into parliament to abolish the body. While the Liberal opposition denounced the move as a “conspiracy” between Labor and the Greens, it is more than likely that the Labor Party will join the opposition in blocking the bill. As for the Greens, for all their posturing as defenders of workers’ rights, the party only objects to the ABCC’s special powers, not the punitive powers against all workers under the existing FWA regime.

The unions have had next to nothing to say about Labor’s new agency. In response to Johns’s appointment, ACTU secretary Jeff Lawrence called only for the abolition of the ABCC declaring the appointment did not change the unions’ view that “the ultimate goal must be one set of laws for all workers, regardless of the industry they work in”—that is, all should be equally penalised.

This response is in line with the unions’ support for the Labor government’s overall FWA industrial relations regime, which they specifically endorsed at two Labor Party national conferences in 2007 and 2009. The FWA legislation places even tougher restrictions on industrial action than the previous Coalition government’s WorkChoices law.

The unions’ endorsement of Labor’s industrial relations laws make clear that the unions have no fundamental objection to the penalisation of construction workers and have no intention of mounting a genuine campaign against the construction watchdog, whether it is the ABCC or FBII. The only changes that the unions continue to seek are those that further enshrine their role as the industrial police for enforcing productivity speedups and suppressing wages.

Leading industry analyst and economic forecaster, BIS Shrapnel, has questioned Treasury’s outlook for engineering construction in the 2010/11 Commonwealth Budget. The very strong Treasury forecast for private new engineering construction is a key driver of the forecast growth in business investment and economic growth in the Budget.

“A good leading indicator of engineering activity is the value of commencements,” says senior manager for BIS Shrapnel’s infrastructure and mining Adrian Hart. “Real private sector engineering construction commencements have fallen from around $11-12 billion per quarter in 2008 to $8 -11 billion per quarter in 2009. The Gorgon LNG project gave commencements a huge lift in the December quarter, but it should be remembered that this project will take six to seven years to complete – we will not see the bulk of this work take place in the next two years.

BIS Shrapnel is forecasting the next acceleration in private engineering construction activity to take place from 2012, as the next round of resources projects simultaneously ramps up. This, of course, depends on the global economy and industrial demand continuing to improve.

“While civil construction will remain at very high levels, a setback in work done will be hard to avoid in 2010/11,” says senior manager for BIS Shrapnel’s infrastructure and mining unit Adrian Hart. “Even given a ramping up of work on various projects, there will still be negative growth for the sector. The decline can be attributed to a double-whammy of a general decline in commencements which occurred through much of 2009, with the notable exception of the Gorgon LNG project, and a likely easing in public sector infrastructure stimulus projects.”

However, senior manager for BIS Shrapnel’s infrastructure and mining Adrian Hart cautions that skills shortages will constrain growth over the coming cycle.

Activity in New South Wales is forecast to plateau at 10% through the next few years as major projects in water (Kurnell desalination plant), harbours (Port Botany and Newcastle coal ports), electricity and other heavy industry (Tumut Pulp Mill) are completed. Roads and rail work however, have been reported to be postponed for more than 20years.

Minister for Education and Employment Julia Gillard, announced in April that the Australian Government would provide $350,000 for two new research projects to boost the nation’s engineering workforce.
She said the projects would be conducted by Australian National Engineering Taskforce (ANET) to assist both the education sector and the industry to combat engineering shortages.

A 2001 study by the CSIRO predicts that as a result of climate change Australia will be hotter and drier in coming decades.

The study’s predictions include:

• Annual average temperatures will rise by 0.4–2°C over most of the continent (compared to 1990 levels) by 2030, and 1–6°C by 2070.

• Lower rainfall will be experienced in parts of south-eastern Australia, wetter conditions are possible in eastern Australia in summer and inland in autumn, in areas where average rainfall increases or stays the same, more frequent or heavier downpours are likely, and there will be more dry spells in regions where average rainfall decreases.

• Sea level will rise at a rate of between 0.8 and 8.0 cm per decade, reaching 9–88 cm above the 1990 level by the year 2100.

• Coral reefs, alpine ecosystems, mangroves and wetlands will be lost, with tropical forests, savannas, deserts and native grasslands also under threat.

• Forest ecosystems will expand in a carbon dioxide–enriched atmosphere, but these gains may be offset by warmer conditions.

• Tropical pests such as the Queensland fruit fly will spread southwards, other temperate pests, like the light brown apple moth, may move to cooler areas.

• For agriculture, there will be a trade-off between the positive impact of higher carbon dioxide levels and the negative effect of lower rainfall and higher temperatures.

Capital Wind Farm

The Capital Wind Farm became operational in October 2009 when it was opened by Prime Minister Kevin Rudd and NSW Premier Nathan Rees. It comprises 67 Suzlon S88 wind turbines which all have a rating of 2.1MW, total installed capacity is 140.7MW. The Capital Wind Farm is located near Bungendore in New South Wales, Australia and has a net capacity factor of approximately 35.8%. This Wind Farm has been billed as the biggest renewable energy project in the state since the Snowy Hydro scheme.

Deluxe Developments worked on the Capital Wind Farm Site at Bungendore during construction phase in conjunction with Suzlon, ABB and Transfield Services.

The Capital Wind Farm, at Bungendore in NSW, will generate enough capacity to power 60,000 homes with its 67 turbines.

It will help power the NSW government's desalination plant at Kurnell, which aims to use 100 per cent renewable energy when it starts supplying water to Sydney in 2010.
